Profeco Warns Voluntary Tips
Profeco Warns Voluntary Tips. In a clear reminder of Mexican legislation, the delegate of the Federal Consumer Protection Agency (Profeco), Álvaro Dávila, made it clear to Puerto Vallarta businessmen that making tips mandatory in the restaurant bill is strictly prohibited.
Profeco Warns Voluntary Tips in a meeting with the National Chamber of the Restaurant Industry and Seasoned Foods of Puerto Vallarta (Canirac Vallarta), Dávila reiterated that tipping must be a total voluntary gratuity and not a requirement imposed by the restaurant or its employee.
This warning comes in a context where many restaurants continue to suggest tips as a fixed percentage in their bills, which contravenes the Federal Consumer Protection Law. According to Dávila including the tip in the ticket or pressuring customers to give tips can be interpreted as a form of coercion.
That is an act that is not only ethically questionable but can also lead to administrative sanctions for the restaurant. “Consumer autonomy is a fundamental principle that must be respected at all times regarding tipping,” he said.
Tipping should be a personal decision of the customer, based on satisfaction with the service received. However, employees in many restaurants seem to be incentivized to pressure customers into tipping calling into question if the tip was voluntary.
Profeco Warns Voluntary Tips is a wakeup call for restaurants to review their internal practices. Failure to comply with these regulations not only affects the reputation of the restaurant but can also lead to financial penalties.
Consumers should have the freedom to decide if and how much they want to tip without feeling forced by restaurant policies or their employees. It is essential for restaurant entrepreneurs to understand that quality service and good food should be sufficient motivation for customers to reward their employees. In addition, they should maintain sufficient wages for employees to survive and not rely on needing tips.
