According to Mexico’s Federal Consumer Protection Law, there are clear rules dealing with Puerto Vallarta Restaurants And LGBTQ Consumer Rights that restaurants, cafés, and clubs must follow — and travelers should be aware of them to avoid unpleasant surprises on the bill and what you should do in case you have a problem.

Canirac Vallarta (The Puerto Vallarta restaurant Chamber of Commerce) invited representatives from Profeco, Mexico’s consumer protection agency, to meet with restaurateurs. Cristian Raúl Limón Delgado, the regional head of Profeco’s Verification Department, outlined the do’s and don’ts for local businesses — and we want to share with you your rights as a consumer in Mexico.

No mandatory tips

Restaurants cannot add a “suggested” or fixed tip percentage to your bill. Tips must always be voluntary.

No minimum consumption charges

Especially at beach clubs in Puerto Vallarta, it is improper to demand a minimum purchase just for using a table or a chair. Profeco suggests that if a venue wants to ensure a fair exchange for premium beachfront space, they should offer a clear “rental fee” that is fully credited toward consumption, rather than an imposed minimum.

No extra credit card fees

Businesses must absorb the cost of processing card payments. Customers should never see an extra line item for paying with Visa, Mastercard, or Amex.

Prices must be final and clear in Mexican pesos

Menus must show the full price you will pay in Mexican pesos  with taxes called IVA. Details like portion sizes, weight of proteins, or number of milliliters in a drink should also be specified.

Promotions must be transparent

A promotion is a discount, while a “sale” means extra product offered. Businesses must clearly display validity dates and restrictions.

Scales and measurements must be accurate

For fresh products or items sold by weight, scales must be calibrated and certified by Profeco.

This guidance is important because Puerto Vallarta’s tourism economy relies heavily on repeat visitors and the expat community. Travelers — especially LGBTQ+ retirees and long-term residents — should feel confident that consumer protections are enforced.

For tourists enjoying Puerto Vallarta gay nightlife, dining, and beach clubs, this means you have rights. You can choose to tip generously when you receive great service, but it cannot be imposed. You can order a single drink at a bar or enjoy a day at the beach club without being told you must spend a certain amount. And if a restaurant tries to charge you more for using your credit card, you have the right to refuse that fee.

If you ever encounter problems such as forced tips, hidden fees, or inflated charges, you can file a complaint with Profeco.

Profeco operates out of the Nuevo Nayarit Business Center and covers both Jalisco and Nayarit municipalities, so travelers and expats have local resources available if issues arise.
